The state of New York does not have a strict bite liability statute.  New York is a “one bite” state, which means that dog bite victims must prove that the dog has a history of biting people before they can take legal action.  If the victim can prove that the dog in question has a history of biting, or a vicious temperament, the victim may be able to hold the dog owner liable.  This means that the dog owner would be responsible for all injuries and costs incurred by the dog bite victim.
